Welcome to YoGetaway.com. These Terms & Conditions (“Terms”) govern your use of our platform as a vendor/property owner. By registering as a vendor and listing any property on our platform, you agree to be bound by these Terms and our general site policies.
1. Eligibility & Vendor Responsibility
- Only individuals or entities who own or legally manage a property and are authorized under Indian law to rent it out may list on YoGetaway.com.
- Vendors must comply with all applicable laws, including but not limited to: Indian Tourism Act, Consumer Protection Act, GST regulations, local municipal and safety regulations relevant to hospitality and lodging.
2. Listing Accuracy & Updates
- Vendors must provide complete, accurate, and truthful information about their listings, including:
- Property descriptions
- Facilities and amenities
- Images (real, recent, and to the best of their knowledge)
- Pricing and availability
- Contact details
- Vendors are responsible for keeping all information up to date and must update details and rates whenever there are changes.
- If a booking is made based on outdated or incorrect pricing or details, the vendor is obliged to honor the booking at the displayed rates and cannot refuse or cancel citing discrepancies in pricing or information.
- Vendors confirm adherence to YoGetaway.com policies and all relevant laws regarding listings.
3. Commission & Payments
- YoGetaway.com charges commission on bookings as per the rate agreed and displayed in the vendor dashboard.
- Commission rates may differ based on stay type (homestay, resort, etc.) and are subject to change with prior notice to the vendor.
- Payments to vendors are made after deducting the applicable commission.
4. Booking Management & Refunds
- Vendors must respond promptly to booking inquiries, confirmation requests, and messages from guests or the platform.
- Cancellations by vendors should be rare and minimized; repeated cancellations or failure to respond may lead to penalties or account suspension.
- Refunds & Cancellations:
- Vendors agree to honor all confirmed bookings.
- Refunds or cancellations initiated by the vendor must follow platform refund policies and comply with applicable laws.
- Customer cancellations will be handled per platform cancellation policy, which vendors must follow.
- Non-compliance may result in penalties, including withheld payments or account termination.
5. Legal Compliance & Documentation
- Vendors must secure and maintain all required licenses, permits, tax registrations (including GST), and safety certifications necessary to operate legally.
- Vendors must provide valid GST invoices upon request by customers or YoGetaway.com.
- Upon request, vendors must submit business registration details, valid GST numbers, star ratings/classifications, and any other legal or regulatory documents required for verification.
- Vendors certify that all submitted documents are authentic, valid, and current.
- Submission of false, forged, expired, or misleading documents will result in immediate termination and possible legal action.
6. Liability & Indemnity
- YoGetaway.com is a platform facilitator and is not the provider of accommodation services.
- YoGetaway.com is not liable for any injury, theft, loss, death, damage, or disputes occurring on vendor premises.
- Vendors assume full responsibility for guest safety, legal compliance, and conduct on their property.
- Vendors agree to indemnify and hold YoGetaway.com harmless from any claims, losses, damages, or legal actions arising from their listings or guest stays.
- Vendors are strongly encouraged to maintain adequate commercial and liability insurance.
7. Dispute Resolution & Jurisdiction
- Any disputes between vendors and guests should be resolved directly between the parties.
- YoGetaway.com may mediate disputes at its discretion but has no obligation to intervene.
- Vendors must first attempt amicable dispute resolution with YoGetaway.com before pursuing legal action.
- If amicable resolution fails, disputes shall be referred to a mutually agreed independent mediator.
- Jurisdiction: All legal disputes arising under these Terms shall be subject exclusively to the jurisdiction of the courts located in Madikeri, Karnataka, India.
8. Acknowledgement of “How It Works – Vendor” Guide
- Vendors confirm that they have carefully read and understood the “How It Works – Vendor” section on YoGetaway.com.
- Failure to review this guide does not excuse non-compliance with its instructions or platform policies.
- YoGetaway.com will not be liable for any misunderstandings or disputes arising from vendor negligence in reviewing this guide.
9. Communication Responsibility
- Vendors must regularly check their registered email, SMS, WhatsApp, and phone calls for booking confirmations, guest inquiries, and platform notifications.
- Most booking confirmations are sent via email; however, important messages may be sent via SMS, WhatsApp, or calls.
- Vendors cannot later claim ignorance or non-receipt of communications due to failure to check these channels.
- Vendors are responsible for keeping their contact information accurate and up to date.
10. Termination & Removal of Listings
- YoGetaway.com reserves the right to remove any listing or terminate vendor accounts for violations of these Terms or misuse of the platform, including but not limited to:
- Fake or misleading listings
- Illegal or discriminatory behavior
- Repeated cancellations or guest complaints
- Non-compliance with legal regulations
- Vendors unhappy with the service may request to delist their property or remove their account with a minimum 30 days written notice.
- Pending bookings and operational obligations must be fulfilled before account closure.
11. Modifications to Terms
- YoGetaway.com may update these Terms at any time, with changes posted on the platform.
- Continued use of the platform after updates constitutes acceptance of the revised Terms.
- Vendors are responsible for periodically reviewing the Terms.
12. Acceptance & Digital Signature
- By registering as a vendor and listing a property, you confirm you have read, understood, and agree to these Terms & Conditions and applicable laws.
- Digital or electronic acceptance via the platform’s registration and checkbox constitutes a legally binding agreement.
